TERMS AND CONDITIONS

Effective Date: July 29, 2026


These Terms and Conditions govern your use of the Four Elements Photo Adventures, LLC website and your registration for or participation in our photography workshops and related activities.


Throughout these Terms and Conditions, “Four Elements Photo Adventures,” “Four Elements,” “we,” “us,” and “our” refer to Four Elements Photo Adventures, LLC. “Participant,” “you,” and “your” refer to the person using our website, registering for a workshop, participating in a workshop, or purchasing services from us.


By using our website, submitting a registration, making a payment, or participating in a workshop, you agree to these Terms and Conditions, our Privacy Policy, our Cancellation and Refund Policy, and any additional workshop-specific terms provided during registration.


1. Our Photography Workshops


Four Elements Photo Adventures offers landscape photography workshops and related educational experiences at various locations in the United States and internationally.


Depending on the workshop, services may include:


  • In-field photography instruction.
  • Classroom or post-processing instruction.
  • Transportation between the designated workshop home base and photography locations.
  • Park admission fees and required location permits.
  • Workshop materials and handouts.
  • Other services specifically identified on the applicable workshop page.


The dates, locations, itinerary, instructors, physical requirements, included services, and excluded expenses may vary by workshop. Participants should carefully review the individual workshop description before registering.


2. Eligibility and Participant Requirements


Unless otherwise approved by Four Elements in writing, participants must be at least 18 years old.


A participant under 18 may attend only with our prior written approval and must be accompanied by a parent or legal guardian. The parent or legal guardian must complete all required registration documents, releases, and acknowledgments on behalf of the minor.


Participants must be capable of safely completing the physical activities described on the applicable workshop page. Activities may include walking or hiking over uneven, wet, sandy, rocky, icy, snow-covered, steep, or otherwise challenging terrain.


Each participant is responsible for evaluating whether a workshop is appropriate for their physical condition, mobility, experience, and comfort level. Participants should consult a qualified medical professional before attending when they have questions about their ability to participate safely.


3. Registration and Acceptance


Submitting a registration request does not guarantee a place in a workshop.


Your registration is confirmed only after:


  • We receive the required deposit or payment;
  • You receive a registration confirmation from Four Elements; and
  • You complete any required participant forms, acknowledgments, or releases.


Workshop availability is limited and registrations may be accepted in the order in which completed payments are received.


We reserve the right to decline or cancel a registration when reasonably necessary for safety, legal compliance, nonpayment, capacity limitations, prior participant conduct, or other legitimate business reasons. When we cancel a registration before the workshop for reasons unrelated to participant misconduct or a violation of these Terms, payments made directly to Four Elements will be handled according to our Cancellation and Refund Policy.


4. Prices and Payment


Workshop prices are displayed on the applicable workshop page or registration form. The workshop description will identify the services included in the registration fee.


Unless expressly stated otherwise, participants are responsible for expenses including:


  • Transportation to and from the designated workshop home base.
  • Airfare and other personal travel expenses.
  • Lodging.
  • Meals and beverages.
  • Travel insurance.
  • Personal photography equipment.
  • Personal purchases and incidental expenses.
  • Passport, visa, vaccination, testing, or entry requirements for international travel.
  • Any other expense not specifically identified as included.


Payments are processed through GoDaddy website and payment services or other payment processors identified during checkout.


You authorize us and our payment providers to charge the payment method you provide for the amounts shown during registration. You represent that you are authorized to use the selected payment method and that the billing information you provide is accurate.


Failure to make a required payment by its due date may result in cancellation of your registration and forfeiture of amounts already paid, subject to our Cancellation and Refund Policy.


5. Domestic Workshop Cancellations


  • Your deposit reserves your place in the workshop.
  • The remaining workshop balance is due 90 days before the workshop start date.
  • If you cancel before the final payment date, your deposit is nonrefundable unless we are able to fill your place before the workshop begins.
  • Any approved refund is subject to a 5% processing fee.
  • The entire registration fee becomes nonrefundable and nontransferable 90 days before the workshop start date.


A participant who registers fewer than 90 days before a domestic workshop may be required to pay the full registration fee at the time of registration. That payment will be nonrefundable and nontransferable unless otherwise stated in writing.


6. International Workshop Cancellations


  • Your initial deposit reserves your place in the workshop.
  • The final payment is due on the date identified on the applicable workshop page or registration materials.
  • If you cancel, the initial deposit is nonrefundable unless we are able to fill your place before the workshop begins.
  • Payments made after the initial deposit are also nonrefundable unless we are able to fill your place before the workshop begins.
  • Any approved refund is subject to a 5% processing fee.
  • The entire registration fee becomes nonrefundable and nontransferable after the final payment date.


International travel requirements can change. Each participant is solely responsible for obtaining and maintaining all passports, visas, travel authorizations, vaccinations, insurance, and other documents or approvals required to enter, remain in, and depart from the destination country.


Failure to obtain required travel documents or comply with entry requirements will be treated as a participant cancellation.


7. Participant Cancellations, Transfers, and Missed Activities


All cancellation requests must be submitted to Four Elements in writing through the Contact Us page or another written method approved by us.


The effective cancellation date is the date on which we receive the written cancellation request.


Workshop registrations may not be transferred to another person or another workshop without our prior written approval. We are not required to approve a requested transfer.


No refund, credit, or price adjustment will be provided for:


  • Late arrival.
  • Early departure.
  • Missed field sessions, classes, meals, transportation, or other activities.
  • A participant’s decision not to attend a particular location or activity.
  • Failure to bring appropriate clothing or equipment.
  • Removal from a workshop because of unsafe, disruptive, unlawful, or inappropriate conduct.
  • Personal illness, injury, travel disruption, transportation delay, or other circumstances outside our control.


We strongly recommend purchasing comprehensive travel insurance that provides appropriate coverage for cancellation, interruption, illness, injury, weather, transportation delays, medical care, emergency evacuation, and lost or damaged property.


8. Cancellation by Four Elements


If Four Elements cancels an entire workshop, registered participants may choose between:


  • A transfer of the registration fees paid directly to Four Elements to another available workshop; or
  • A refund of the registration fees paid directly to Four Elements.


Unless required by applicable law, this transfer or refund is the participant’s sole remedy for cancellation of an entire workshop by Four Elements.


We are not responsible for airfare, lodging, rental vehicles, meals, insurance premiums, passport or visa expenses, equipment rentals, lost wages, or other personal costs incurred in connection with a canceled workshop.


Participants should purchase refundable travel arrangements or appropriate travel insurance whenever possible.


9. Itinerary, Location, and Schedule Changes


Landscape photography depends on conditions that cannot be controlled or guaranteed. We may change the itinerary, schedule, photography locations, transportation arrangements, instructors, classroom location, or planned activities when reasonably necessary.


Changes may be made because of:


  • Weather or lighting conditions.
  • Wildfires, flooding, snow, ice, excessive heat, storms, or other natural conditions.
  • Road or trail closures.
  • Park, government, or property restrictions.
  • Permit limitations.
  • Wildlife activity.
  • Safety concerns.
  • Instructor illness or emergency.
  • Transportation problems.
  • Changes in lodging or facility availability.
  • Events outside our reasonable control.


Reasonable itinerary or schedule changes do not constitute cancellation of the workshop and do not entitle a participant to a refund.


We will make reasonable efforts to provide a suitable alternative location, activity, instructor, or schedule when conditions require a change, but an equivalent photographic opportunity cannot be guaranteed.


10. Weather and Photographic Conditions


Workshops generally proceed during changing or less-than-ideal weather unless Four Elements determines that conditions create an unreasonable safety risk or make the workshop impracticable.


Participants should arrive prepared for the conditions described in the workshop materials, which may include rain, snow, ice, wind, heat, cold, insects, mud, dust, high elevation, darkness, or rapidly changing temperatures.


We do not guarantee:


  • Specific weather or lighting conditions.
  • Sunrises, sunsets, clouds, fog, snow, fall color, wildflowers, or night-sky visibility.
  • Wildlife sightings.
  • Access to a specific location.
  • Any particular photograph or photographic result.
  • That every scheduled activity will occur exactly as described.


The absence of preferred photographic conditions does not entitle a participant to a refund or credit.


11. Safety and Instructions


Participant safety is a priority, but outdoor activities involve inherent and unpredictable risks.


Participants must:


  • Follow the reasonable directions of Four Elements instructors and guides.
  • Remain within designated areas.
  • Follow applicable park, property, trail, traffic, and environmental rules.
  • Use seat belts when transportation is provided.
  • Wear appropriate clothing and footwear.
  • Carry any required water, medication, lighting, and safety equipment.
  • Avoid conduct that places themselves or others at unreasonable risk.
  • Inform an instructor when they do not feel capable of safely completing an activity.
  • Respect wildlife, natural resources, other participants, instructors, and members of the public.


A participant should not rely on an instructor’s first-aid training as a substitute for professional medical care.


In an emergency, Four Elements may contact emergency services and take actions reasonably believed necessary to protect a participant’s health or safety. The participant is responsible for medical, evacuation, transportation, and related expenses incurred on their behalf.


12. Right to Refuse or End Participation


Four Elements may restrict or end a participant’s involvement in a location, activity, transportation service, or entire workshop when we reasonably believe the participant:


  • Is unable to participate safely.
  • Refuses to follow safety instructions.
  • Engages in threatening, abusive, harassing, discriminatory, disruptive, or unlawful conduct.
  • Interferes with the experience or safety of other participants.
  • Damages property or natural resources.
  • Is impaired by alcohol, cannabis, illegal drugs, or the misuse of medication.
  • Violates park regulations, local laws, or these Terms and Conditions.


A participant removed for these reasons will not be entitled to a refund, reimbursement, or credit and will be responsible for arranging and paying for their own transportation and lodging.


13. Transportation During Workshops


When transportation during a workshop is identified as included, it generally begins and ends at the designated workshop home base or meeting location.


Participants are responsible for arriving at the meeting location on time. We are not responsible for missed activities caused by a participant’s late arrival.


Transportation may be provided in vehicles owned, leased, rented, or operated by Four Elements, an instructor, or a third-party provider. Participants must follow all safety instructions and wear available seat belts.


Large equipment cases, excessive luggage, mobility devices, or other special transportation needs must be discussed with us before registration. We cannot guarantee that every vehicle will accommodate equipment or needs that were not disclosed in advance.


14. Equipment and Personal Property


Participants are responsible for bringing suitable cameras, lenses, memory cards, batteries, chargers, clothing, footwear, computers, software, and other personal equipment recommended for the workshop.


Each participant is responsible for:


  • Safeguarding their equipment and personal property.
  • Maintaining appropriate insurance coverage.
  • Backing up photographs and other files.
  • Verifying that equipment is functioning before and during the workshop.
  • Protecting equipment from weather, water, theft, impact, sand, dust, and other hazards.


Four Elements is not responsible for lost, stolen, forgotten, damaged, or malfunctioning equipment, luggage, vehicles, files, memory cards, or other personal property, except to the extent responsibility cannot be excluded under applicable law.


15. Assumption of Risk and Participant Agreement


Photography workshops may involve remote locations, travel by motor vehicle, hiking, uneven terrain, wildlife, severe weather, darkness, water, snow, ice, cliffs, falling objects, limited cellular service, delayed emergency response, and other known and unknown hazards.


By participating, you acknowledge that these activities involve risks that cannot be completely eliminated, even when reasonable precautions are taken.


Each participant may be required to review and sign a separate Participant Agreement, Assumption of Risk, and Release of Liability before attending. Failure to complete the required agreement may result in cancellation of the participant’s registration under the applicable cancellation policy.


These Terms do not waive liability for gross negligence, reckless conduct, intentional misconduct, or any responsibility that cannot legally be waived.


16. Participant Health and Accessibility


Participants are responsible for determining whether they are physically and medically capable of participating.


Before registration, participants should review the walking distances, elevation, terrain, climate, transportation, and other physical requirements identified on the workshop page.


You should contact us before registering when you require a reasonable accommodation or have mobility needs that may affect transportation or access to workshop locations. We will consider reasonable requests, but remote terrain, third-party facilities, vehicle configurations, and park restrictions may limit available accommodations.


Participants are responsible for bringing and properly managing their personal medication, mobility aids, dietary supplies, and medical equipment.


17. Non-Photographer Participants and Guests


Spouses, friends, or companions may attend as non-participants only with our prior approval and payment of the applicable non-participant fee.


Unless otherwise stated, the non-participant fee is 75% of the regular workshop price.


Non-participants:


  • May accompany the group only at approved locations and activities.
  • Are subject to these Terms and all safety requirements.
  • May be required to sign participant agreements and liability documents.
  • May not interfere with photography instruction or prevent a registered participant from receiving instruction.
  • Are not entitled to individual photography instruction unless otherwise agreed in writing.


Unregistered guests may not join workshop transportation, field sessions, meals, classroom sessions, or other activities without our prior approval.


18. Photography Instruction and Results


Our instructors provide education, feedback, demonstrations, and practical guidance based on their professional judgment and experience.


Photography is a creative and technical activity, and individual results vary. We do not guarantee that participation will produce:


  • A particular image.
  • Professional-level skills.
  • Commercial success.
  • Publication, awards, sales, or recognition.
  • Mastery of a specific camera, software program, or editing technique.


Participants remain responsible for their own creative, technical, safety, and equipment decisions.


19. Copyright in Participant Photographs


Participants retain ownership of the photographs they create during a workshop, subject to applicable laws and any restrictions imposed by parks, property owners, permit authorities, or identifiable subjects.


Participation does not grant Four Elements ownership of a participant’s photographs.


We will not use a participant’s photograph in advertising or promotional materials without permission, except when the photograph has already been made publicly available and the use is otherwise permitted by law. When appropriate, we will make reasonable efforts to provide photographer credit.


Participants are responsible for obtaining any releases, permits, or permissions required for their own commercial use of photographs.


20. Photographs and Video of Workshop Activities


Four Elements or other participants may take photographs or video during workshop activities.


You acknowledge that you may appear incidentally in group photographs, behind-the-scenes images, or recordings made in public or group settings.


We will obtain appropriate permission before intentionally using an identifiable image of you as a primary subject in our advertising or promotional materials. Participants who prefer not to appear in promotional photographs should notify us in writing before the workshop and remind an instructor at the beginning of the workshop.


We cannot control photographs or recordings independently created or published by other participants or members of the public.


21. Instructor Materials and Intellectual Property


Workshop presentations, handouts, guides, lesson plans, processing demonstrations, videos, website content, logos, graphics, and other instructional materials provided by Four Elements are owned by or licensed to Four Elements and are protected by intellectual-property laws.


Materials are provided for the participant’s personal, noncommercial use.


Without our prior written permission, participants may not:


  • Reproduce or distribute workshop materials.
  • Record classroom or processing sessions.
  • Sell, publish, upload, or publicly share instructional materials.
  • Use our materials to teach or operate a competing workshop.
  • Use our business name, logos, or branding in a way that suggests sponsorship or endorsement.


Participants may take personal notes and apply the techniques learned to their own photography.


22. Third-Party Providers and Locations


Workshops may involve services, facilities, or locations operated by third parties, including:


  • Hotels and lodging providers.
  • Restaurants and caterers.
  • Airlines and rental-vehicle companies.
  • Parks and government agencies.
  • Private property owners.
  • Transportation providers.
  • Payment processors.
  • Tour operators or local guides.


These third parties are independent from Four Elements and may impose their own rules, terms, waivers, schedules, and privacy practices.


Four Elements is not responsible for the acts, omissions, availability, service quality, financial condition, or policies of an independent third party, except as required by applicable law.


Discounted lodging rates or third-party recommendations are provided as a convenience and do not constitute a guarantee or endorsement.


23. Website Use


You may use our website only for lawful personal or business purposes related to learning about, communicating with, or purchasing our services.


You may not:


  • Attempt to gain unauthorized access to the website or connected systems.
  • Introduce malicious code, viruses, automated scraping tools, or disruptive technology.
  • Impersonate another person.
  • Submit false registration or payment information.
  • Copy or commercially exploit website content without permission.
  • Use the website to harass others or engage in unlawful activity.
  • Interfere with the security, functionality, or availability of the website.


We may suspend or restrict website access when necessary to protect the website, our business, or other users.


24. Website Information and Availability


We make reasonable efforts to provide accurate workshop descriptions, prices, dates, and availability. However, typographical errors, technical errors, outdated information, or temporary website interruptions may occur.


We may correct errors and update website content at any time. If a material error affects a confirmed registration, we will contact the affected participant and provide an appropriate opportunity to accept the corrected information or cancel as required by applicable law.


We do not guarantee that the website will always be uninterrupted, secure, or error-free.


25. Privacy


Our collection and use of personal information are described in our Privacy Policy.


By using the website or registering for a workshop, you acknowledge that registration information may be processed by our website host, payment processor, email provider, analytics provider, and other service providers necessary to operate our business.


26. Electronic Communications and Agreements


By submitting your contact information or registering online, you consent to receive registration confirmations, payment notices, workshop information, safety updates, itinerary changes, and other service-related communications electronically.


Selecting an acceptance checkbox, submitting an online registration, or providing an electronic signature constitutes your agreement to the applicable electronic document to the extent permitted by law.


You are responsible for maintaining a current email address and reviewing workshop communications.


Marketing communications may be discontinued by using the unsubscribe method provided in the communication.


27. Disclaimer of Warranties


To the fullest extent permitted by law, the website, workshop information, instructional materials, and services are provided on an “as available” basis.


Four Elements does not make warranties regarding specific weather, access, photographic results, uninterrupted website availability, or the suitability of a workshop for a particular participant.


Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded.


28. Limitation of Liability


To the fullest extent permitted by applicable law, Four Elements and its owners, instructors, employees, contractors, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost income, lost opportunities, lost data, lost photographs, or travel expenses.


Except for liability that cannot legally be limited, Four Elements’ total liability arising from a workshop or registration will not exceed the amount the affected participant paid directly to Four Elements for that workshop.


This limitation does not apply to gross negligence, reckless conduct, intentional misconduct, or any liability that applicable law does not allow us to exclude or limit.


29. Responsibility for Losses Caused by a Participant


To the extent permitted by law, a participant is responsible for losses, property damage, fines, penalties, or third-party claims caused by that participant’s unlawful conduct, intentional misconduct, violation of these Terms, or failure to follow applicable park or property rules.


This provision does not require a participant to compensate Four Elements for losses caused by Four Elements’ own negligence or misconduct.


30. Events Beyond Our Control


Four Elements will not be responsible for delay, modification, interruption, or failure to perform caused by events beyond our reasonable control, including:


  • Severe weather or natural disasters.
  • Wildfires, floods, earthquakes, or public-health emergencies.
  • Government restrictions or park closures.
  • War, terrorism, civil unrest, or security threats.
  • Transportation shutdowns or fuel shortages.
  • Labor disputes.
  • Utility, communications, or technology failures.
  • Instructor illness, injury, or family emergency.
  • Unavailability of essential third-party services.


When such an event affects a workshop, we may modify, postpone, relocate, or cancel affected activities. Refunds or credits, when available, will be determined under the applicable Cancellation and Refund Policy and any nonrefundable costs already committed to third parties.


31. Order of Precedence


The following documents may apply to a workshop:


  • A separately signed Participant Agreement, Assumption of Risk, and Release of Liability.
  • The workshop-specific registration form and description.
  • The Cancellation and Refund Policy.
  • These Terms and Conditions.
  • The Privacy Policy.


If the documents conflict, the more specific document will control the subject it directly addresses. A separately signed participant agreement will control matters involving assumption of risk and liability, while the applicable workshop page and Cancellation and Refund Policy will control pricing, inclusions, payment deadlines, and cancellation terms.


32. Severability


If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law or removed when necessary. The remaining provisions will continue in effect.


33. No Waiver


Failure by Four Elements to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.


34. Assignment


Participants may not transfer their rights or obligations under these Terms without our prior written consent.


Four Elements may assign its rights and obligations as part of a merger, sale, reorganization, or transfer of the business, subject to applicable law.


35. Changes to These Terms


We may update these Terms periodically to reflect changes in our workshops, website, business practices, service providers, or legal requirements.


Updated Terms will be posted on the website with a revised effective date. The Terms in effect when a participant completes registration will generally govern that registration unless a later change is required by law or accepted by the participant.


36. Entire Agreement


These Terms, together with the applicable workshop description, registration materials, Cancellation and Refund Policy, Privacy Policy, and any separately signed participant agreement, constitute the complete agreement regarding the applicable website use or workshop registration.


Statements or promises not included in these documents are not binding unless confirmed in writing by an authorized representative of Four Elements.
